Emergency Powers for Timeshare HOAs
COVID-19 presented unprecedented challenges for timeshare HOAs who were forced to alter their operations by restricting owner use or even closing entirely. The Florida Department of Business & Professional Regulation (DBPR) issued Emergency Order 20-04, which authorized HOAs to take significant emergency actions, unless specifically prohibited under the governing documents. The order also suspended a number of requirements for the submittal of documents and reports for HOAs and timeshare plans. While it was useful for many timeshare HOAs in Florida, there were some timeshare association structures that were not recognized in the order.
ARDA has contacted DBPR to discuss emergency provisions that would mirror the existing Order for all timeshare associations along with a few additional items specific to timeshare HOAs that were not covered in the Order. ARDA has also convened a working group of to identify other states where regulatory relief is needed during the pandemic.
