Privacy Policy

The American Resort Development Association (“ARDA”) is committed to protecting your privacy. This Privacy Policy is designed to answer your important questions about privacy including, what information we collect about you, how we protect and use that information, and how to contact us regarding your information.
This Privacy Policy applies to ARDA.ORG and any successor website (collectively, the “Websites”) and all information entrusted to us by our clients and business partners in the delivery of our core services. By using the Websites or submitting information to ARDA, you consent to allow ARDA to use that information in accordance with this Privacy Policy, including ARDA’s cookie policy, as explained below.
The Types of Information We Collect
While using our Websites, we may ask you to provide us with certain personal information that can be used to identify you (“Personal Data”). This Personal Data includes, for example, first and last name, address, telephone number, and email address.
ARDA may also collect information from our members and business partners in the delivery of our core business services. If you are a member or a business partner, it is your responsibility to ensure that all personal data provided to ARDA by you or on your behalf is collected in compliance with all applicable law (including without limitation, data protection and privacy laws), including as required, providing the data subjects with information notices and obtaining their valid consent, approval or authorization.
ARDA may also collect information on how the Websites are accessed and used (“Usage Data”). This Usage Data includes, for example, information such as your computer’s Internet Protocol address, browser type, browser version, the pages of our Websites that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data. ARDA, through its digital marketing partners, may also combine this Usage Data with other user and device data from open and permissioned sources to better engage our target audience across devices.
ARDA may collect some of this Usage Data through data collection tools such as cookies, web beacons, browser fingerprinting, and similar information-gathering technologies. See the below section on Cookies for additional information.
Cookies
We use cookies and similar tracking technologies to track the activity on our Websites and hold certain information. A cookie is a small text file that a website saves on your computer or mobile device when you visit the site. ARDA and our digital marketing partners or service providers use cookies and other technologies to customize and optimize your experience on the Websites. When you use visit the Websites, ARDA or a third party may place a number of cookies in your browser.
You can control and/or delete cookies as you wish. You may be able to modify your browser preferences to accept all cookies, to be notified when a cookie is set, or to reject all cookies. If you choose not to accept some or all cookies, certain Website features may not function properly.
ARDA may use cookies on the Websites (a) to allow site visitors to personalize their experience, (b) to track a user session, (c) to track and report website traffic and (d) support our promotional activities and website development.
How We Use the Information We Collect
ARDA uses the information we collect for various purposes:
- To provide and maintain the Websites
- To monitor usage of the Websites
- To inform digital marketing campaigns
- To support our core mission of promoting the growth and development of the timeshare industry
- To support and improve our customer support process
- To protect our rights and property and the rights and property of others or to take precautions against liability
- To detect and prevent fraud
- To comply with applicable laws and regulations, including to respond to a court order, subpoena, or search warrant
Sharing Your Information
Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.
If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there. By consenting to this Privacy Policy and submitting your information to ARDA, you consent to the transfer of your information.
ARDA will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.
Disclosing Your Information
ARDA will not sell your information to list companies or any outside vendors for profit or gain.
ARDA does not share personal data (phone numbers) and consent with third parties/affiliates or partners.
ARDA may also disclose your Personal Data in the good faith belief that such action is necessary to:
- To comply with a legal obligation
- To protect and defend the rights or property of ARDA
- To prevent or investigate possible wrongdoing in connection with the Websites or the delivery of ARDA’s core services
- To protect the personal safety of any individual or of the public
- To protect against legal liability
Email Communications
It is our intention to only send you email communications that you want to receive. When you provide us with your email address through membership sign-up, event registration, or otherwise, we will periodically contact you via email about ARDA’s advocacy efforts, programs, and member support services. Every time you receive an email from ARDA, you will be provided with the opportunity to opt-out of future emails by following the instructions provided in the email. You may also opt-out by sending an opt-out request via the contact information listed below.
Please allow 10 business days for us to process your opt-out request, and include your email address if you opt-out via postal mail. Note that even if you unsubscribe or opt-out, we may still send you transaction-related or other service-related emails.
Please note that ARDA will never send you an email requesting your password, credit card number, social security number, or other similar personal or privacy identification information. If you receive an email that looks like it is from ARDA, but asks for your personal identification information, it is a fraudulent email, and you should not reply or provide the requested information.
The CAN-SPAM Act
The CAN-SPAM Act is a law that sets rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and specifies penalties for violations.
To comply with the CAN-SPAM Act, we agree to do the following:
- Never use false or misleading header information
- Never use deceptive subject lines
- Identify the message as an ad or promotion, if it is one
- Include the physical address of our business or headquarters
- Provide a link to unsubscribe at the bottom of each email
- Honor opt-out requests promptly
- Monitor third-party email marketing services for compliance, if one is used
Data Security
The security of your data is important to us. The Personal Data you provide is stored in a secure electronic database that has access limited to only those who need to know your information. ARDA employs reasonable precautions to prevent your Personal Data from loss, misuse, unauthorized access, disclosure, alteration or destruction. We also take all necessary steps to ensure your information is reliable for its intended use, accurate, complete and current. This is achieved by storing your information in a secure electronic database that has physical, electronic and supervisory procedures in place to protect your information.
Service Providers
We may employ third party companies and individuals (“Service Providers”) to maintain the Websites, to host the Websites on our behalf, to perform Website-related services or to assist us in analyzing how our Websites are used. These Service Providers have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
Retaining Information
ARDA will only retain your Personal Data for as long as necessary to fulfill the purposes for which ARDA collected it. In some circumstances we may anonymize your Personal Data so that it can no longer be used to identify you, in which case we may use such information without further notice to you.
Links to Other Websites
The Websites may contain links to other websites. You should carefully review the privacy policies and practices of other websites, as we cannot control or be responsible for their privacy practices.
Changes To This Privacy Policy
We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. You should review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
